Judges should stay away from the political debate on judicial reform: Laynez Potisek

The Minister of the Supreme Court of Justice of the Nation (SCJN), Javier Laynez Potisek, He pointed out that the judges constitutional must remain absent of the political debatebut not of the technical discussion, because they are reforms which, if approved, will have an impact on the way justice is administered.

In the context of the discussion on the presidential initiative for constitutional reform to Judicial power of the Federation and local judiciaries, —which is discussed in the Congress of the Union—, the minister commented that judges should be allowed to express their objections, questions and doubts regarding these momentous reforms.

The proposed changes may also impact the organization of the Federal Judicial Branch. He ruled out that these opinions mean that criteria are being put forward and, thus, the Court would be unable to resolve a possible case on the subject.

“How is it possible that I cannot have an opinion? For example, regarding the election of ministers, judges, magistrates, that is, a reform of this importance and that you cannot say anything (…) that we can say: it is not convenient, it is not a good reform, the election is not the solution to the problem that is intended to be solved in terms of the protection of human rights,” he said.

Minister Laynez Potisek pointed out that judicial reform is necessary, but he considered that there should be an exercise in self-criticism, in which an analysis is made to determine what can be changed to improve the Judicial Branch of the Federation.
