French justice ruled again on Wednesday, ordering Meta “to implement, by any effective means, measures to prevent the dissemination of advertisements” fraudulently using the Barrière brand “on Facebook, Instagram and Messenger targeting the public of the ‘European Union “.

To date, in France, these fraudulent advertisements have been viewed more than 80 million times, deplores the Barrière group in its press release, stressing that “unlike other players in the digital world, Meta has not taken effective measures” against these false advertisements.

Meta will have to pay 10,000 euros to Barrière

In its “interim order of withdrawal”, the justice asks Meta “to take all measures likely to ensure the conservation of the names, first names, company name, email address, pseudonyms used, of the account holders associated with the disputed advertisements described in the request” for a period of twelve months. Meta will also have to pay 10,000 euros to the Barrière group. The Barrière group’s request to accompany the measures to filter disputed advertisements with a penalty was, however, rejected.

“It is an unprecedented decision which pushes them to filter proactively on the basis of intellectual property” according to Mickael Piquet-Fraisse, lawyer for the Barrière group, interviewed by Le Parisien. “There is also a risk for them that this decision by a Parisian judge will spread across Europe because it is based on European legislation,” points out the council.

“We welcome this court decision which reminds us that the digital world is not a lawless zone and that the law applies to everyone,” said the group’s co-president, Alexandre Barrière, in the press release. “We are now expecting strong measures from the French and European public authorities to stem a scourge which harms not only the Barrière group, but also more and more European companies,” he continues, saying he is “determined to engage in all new initiative which would be necessary to defend » the group.
