Federal Judge Orders Release of 5-Year-Old Detained by ICE, Cites Constitutional Violations

A federal judge ordered the release on Saturday, January 27, of 5-year-old Liam Conejo Ramos from immigration detention, a case that has ignited outrage over the tactics of Immigration and Customs Enforcement (ICE). The ruling underscores growing concerns about the treatment of asylum seekers and the potential for trauma inflicted on children within the U.S. immigration system.

Unconstitutional Detention Ruled

Judge Fred Biery of the Federal District Court for the Western District of Texas ruled that the detention of Ramos and his father, Adrian Conejo Arias, was unconstitutional. Both are asylum seekers who were apprehended earlier this month in a Minneapolis suburb. The judge’s decision comes after a scathing assessment of the government’s actions, accusing agents of prioritizing deportation quotas over due process and basic human decency.

“They seek nothing more than some modicum of due process and the rule of law,” Judge Biery wrote in his opinion, adding that immigration agents were “traumatizing children.” He further asserted that the case stemmed from an “ill-conceived and incompetently-implemented government pursuit of daily deportation quotas, apparently even if it requires traumatizing children.”

Did you know?-ICE, established in 2003, operates under the Department of Homeland Security and is responsible for enforcing immigration laws within the U.S. Its actions have been subject to frequent legal challenges.

“Bait” Allegations Spark Public Outcry

The circumstances surrounding the detention have drawn widespread condemnation. According to officials at Columbia Heights Public schools in Minnesota,ICE agents detained the father as he and Liam were returning home from school pickup on January 20. Disturbingly, agents allegedly used the child to gain entry into the family home, asking him to knock on the door to ascertain if others were present.

Superintendent Zena Stenvik stated that agents reportedly used the child as “bait” to see if anyone else was home. A photograph of a federal agent holding onto Liam’s Spider-Man backpack quickly whent viral, becoming a potent symbol of the incident’s perceived cruelty.

Writing in The Washington Post, Phillip Kennicott described the image as possessing “global moral urgency,” comparing it to iconic photographs that have historically spurred societal change.

Father and Son’s Ordeal

Following their detention, the father and son were transported to a detention center in Texas, where Liam reportedly fell ill, according to his mother. The judge’s ruling highlighted the severity of the situation, accusing the federal government of demonstrating “ignorance of an American historical document called the Declaration of Independence” and dismissing “that pesky inconvenience called the Fourth Amendment.”

Pro tip-the Fourth Amendment to the U.S. Constitution protects individuals from unreasonable searches and seizures. this protection extends to immigrants, regardless of their legal status.

In a striking conclusion to his ruling, Judge Biery included the now-iconic photograph of Liam alongside two verses from the Bible: Matthew 19:14 – “Let the children come to me, and do not hinder them; for to such belongs the kingdom of heaven” – and John 11:35, “Jesus wept.” These inclusions underscore the profound emotional impact of the case and the judge’s clear condemnation of the government’s actions.

The release of Liam and his father marks a notable, though potentially temporary, victory for advocates of immigrant rights.

Why did this happen?

This case unfolded because ICE agents detained Liam Conejo Ramos and his father, Adrian Conejo Arias, while they were returning home from school pickup. The detention was based on the family’s status as asylum seekers. The judge ruled the detention unconstitutional, citing concerns over due process, the prioritization of deportation quotas, and the trauma inflicted on the child. Allegations that agents used Liam as “bait” to search the family home further fueled the controversy.
