New York court overturns Harvey Weinstein’s abuse conviction; orders new trial

The highest court of NY annulled the conviction for rape Harvey Weinstein in 2020 and ordered a new trial in the historic case Me Too.

This Thursday the New York Court of Appeals overturned the 2020 conviction of former film producer Harvey Weinstein for sexual crimes, whose case sparked the #MeToo movement, and ordered a new trial.

In a decision by 4 votes to 3, the justices cite errors in the conduct of the trial, such as the inclusion of the testimony of a woman who was not part of the accusations against the once powerful Hollywood film producer.

“Order reversed and new trial,” the 11-page court document concludes.

Weinstein, 72, was found guilty of rape and sexual assault by a jury in New York and sentenced to 23 years in a prison in Rome, New York. Another California court imposed a 16-year sentence on him in 2022 for raping a woman in a hotel in Los Angeles.

The powerful producer was accused by more than a hundred women of sexual crimes.

In 2017, accusations began to emerge against the Oscar-winning producer, launching the #MeToo movement, paving the way for hundreds of women to fight against sexual violence in the workplace.

“With today’s decision, this court continues to thwart the consistent progress that survivors of sexual violence have fought for in our criminal justice system,” said one of the justices who voted against overturning the conviction.
