New York Challenges US Attorney’s Authority in Trump Investigations

New York Attorney General Letitia James is mounting a legal challenge to teh authority of a federal prosecutor investigating her civil cases against Donald Trump and the National Rifle Association, escalating a battle over the scope and legitimacy of the investigations.

The New york Attorney General’s office is expected to appear in federal court in Albany on Thursday to seek the disqualification of John Sarcone,the acting US attorney for the Northern district of New York.

Legitimacy of Sarcone’s Appointment

Attorney General James, a Democrat, is contesting the appointment of Sarcone, who was initially selected by the Trump management. The state argues that Sarcone lacks the proper authority to pursue the subpoenas, which seek data pertaining to the New York Attorney General’s civil investigations into the finances of the Trump Organization and the operations of the NRA.

According to Judge Lorna Schofield, Thursday’s hearing will focus specifically on the legality of Sarcone’s appointment and whether any subpoenas issued under his authority are therefore invalid. James herself will not be present at the hearing.

A pattern of Disputed Appointments

This case is not isolated. It represents the latest in a series of challenges to appointments made by the Trump administration of acting US attorneys, with at least four previous appointments having been deemed unlawful by the courts.

Sarcone’s path to the position involved an initial appointment by attorney General Pam Bondi in March, followed by a 120-day term. When district court judges failed to appoint a successor, Bondi designated Sarcone as a special attorney and first assistant US attorney in July, effectively allowing him to assume the role of acting US attorney.

Subpoenas and a Criminal Inquiry

In August, Sarcone issued two subpoenas to the New York Attorney General’s office as part of a criminal investigation into potential violations of constitutional rights during the state’s civil investigations.

“because sarcone has no legitimate authority to serve as Acting U.S. Attorney, any process sought by him in that capacity, like these two subpoenas, is unauthorized and unlawful,” lawyers for New York asserted in a court filing.

Justice Department Defends appointment

The Justice Department maintains that Sarcone’s appointment is lawful. Even if it were not, prosecutors argue that his position as a special attorney grants him the authority to conduct grand jury proceedings.

“The office of United States Attorney was vacant when he was designated as FAUSA and remains vacant, so Mr. Sarcone ‘shall perform’ the duties of the office of united States Attorney on an acting basis,” prosecutors stated in a court filing. “The remedy the NYAOG seeks here – quashing the subpoenas – is simply not available even if Mr. Sarcone is not properly holding the office of Acting united States Attorney as, as a Special Attorney, he had authority to conduct grand jury proceedings.”

However, this position has been repeatedly rejected by other judges, including a recent ruling on Monday by the third Circuit court of Appeals upholding a previous decision that found the appointment of Trump’s former personal attorney, Alina Habba, as acting US attorney for New Jersey to be unlawful.

Underlying Civil Cases

Sarcone’s investigation stems from two prominent civil lawsuits brought by James. In 2022,she sued donald Trump and the Trump Organization,alleging they fraudulently inflated the value of properties to secure favorable loan and insurance rates.A judge initially found Trump and his sons liable for fraud, ordering a payment of over $350 million plus interest. While a state appeals court upheld the finding of fraud, it deemed the financial penalty excessive, and both parties have filed appeals.

The state also filed a lawsuit against the NRA and its leadership, alleging violations of nonprofit laws. A jury later found that the NRA had mismanaged charitable funds.

The outcome of Thursday’s hearing could significantly impact the ongoing investigations and the legal battles surrounding both the Trump Organization and the NRA, perhaps reshaping the landscape of accountability for these high-profile cases.
