New York issues Consumer Warning After Med Spa Investigation Reveals Unlicensed Practices and Counterfeit Products

New York residents are urged to exercise caution when seeking medical spa treatments following a statewide investigation that uncovered alarming safety violations, including unlicensed procedures and the use of potentially hazardous products.

The New York Department of State has issued a warning to the public after a probe revealed widespread issues within the state’s burgeoning med spa industry. The investigation, initiated in New York City, found evidence of unauthorized medical procedures, counterfeit products, and expired medications being used on unsuspecting consumers.

Statewide Investigation Uncovers Widespread Issues

Phase one of the investigation was spearheaded by the Department of State’s Division of Licensing Services, in collaboration with the Department of Health and the Office of the Attorney General.As the State Health Commissioner Dr. James McDonald warns, “licensed or unqualified staff, dirty needles, expired or counterfeit drugs such as Botox or fillers, and unsanitary conditions can lead to serious injury or even death. I urge consumers to pay close attention to our tips so they can get the services they want and not pay the ultimate price with a botched treatment.”

Dangerous Substances and Unqualified staff Found

Investigators reportedly discovered a disturbing array of safety concerns during inspections. These included the presence of expired and suspected counterfeit products,as well as controlled substances such as fentanyl,xylocaine,and propofol. Additionally, inspectors found sharps containers containing both used and unused needles, alongside medical devices intended for procedures like laser liposuction, buttock augmentation, cryotherapy, and laser tattoo removal.

The investigation also revealed that some individuals were allegedly providing medical services without the necessary licenses or qualifications.According to the Department of health,ensuring providers have proper qualifications and training is crucial,particularly given the increasing popularity of cosmetic med spa procedures. “Licensed health care professionals undergo rigorous training to understand the complexities of human physiology, and are the only individuals qualified to perform these services,” stated State Health Commissioner Dr. James mcdonald.”The Department of Health will continue to investigate and hold individuals and practices accountable who offer unauthorized services that put people’s lives at risk.”

Inspection Results and Ongoing Enforcement

A total of 223 businesses across New York state were inspected. Of those, 87 were cited for potential violations, including the unlawful practise of medicine.While most cases are still pending hearings, penalties already levied against some businesses range from monetary fines to license suspensions or revocations.

The Division of Licensing Services confirmed that inspections will continue as part of its regular annual program. This ongoing oversight comes in response to both inspection findings and reported injuries to med spa customers. These injuries have included allergic reactions,burns,double vision,and harmful poisoning linked to injections of counterfeit drugs administered by unlicensed personnel.

Consumer Guidance for Safe Med Spa Visits

In light of these findings, the Department of State’s divisions of Licensing and Consumer Protection are offering guidance to help consumers protect themselves. Health officials recommend the following before booking a med spa service:

  • Ensure the business lists a licensed medical director.
  • verify credentials through official state websites.
  • Check for reviews or complaints from other consumers.
  • Always schedule a medical consultation beforehand.
  • Ask about the qualifications and experience of the person performing the procedure.
  • Inquire about the facility’s protocol for handling complications.

By taking these precautions, consumers can considerably reduce their risk of experiencing adverse effects from med spa treatments and ensure they are receiving care from qualified professionals.
