The said father, who worked as a painter, contracted a pneumococcal infection in June last year and died as a result.

After signing the contract, his grueling work began and he worked for 104 consecutive days from February to May last year, taking only one day off on April 6 to rest.

Later on May 25, his condition worsened rapidly and on May 28 his colleagues had to rush him to the hospital where doctors diagnosed him with a lung infection and breathing problems. He died on June 1. .

After his father’s death, his family filed a lawsuit against the company, alleging gross negligence.

The case was filed after authorities controversially ruled that the father’s death was not due to overwork, but his family argued that overwork and lack of rest directly contributed to his death.

However, the company blamed Abaao’s already poor condition, saying that his failure to seek timely medical attention worsened the situation, the company also claimed that Abaao’s workload was reasonable and the extra hours worked. were voluntary.

However, a Chinese court ruled in favor of Abao’s family, holding Abao’s company 20 percent responsible for his death.

The court found that the father died of a pneumococcal infection causing multiple organ failure, which is often associated with a weakened immune system.

The court also determined that Abao’s 104 consecutive days of work was in flagrant violation of Chinese labor law, which expressly stipulates a maximum of 8 working hours per day and an average of 44 hours per week. is

The court ordered Abao’s family to pay a total of 400,000 yuan in damages, which the company appealed but was rejected.
