Parties want to change the law – top lawyer warns of “Corona measures forever” – domestic policy

The Corona emergency (“epidemic situation”) is running out, but the measures (e.g. mask requirement, 3G rule) should remain.

BILD learned: Union, SPD, Greens and FDP want to agree on a change in the law in the next few days.

A week ago, Health Minister Jens Spahn (41, CDU) called for an end to the “epidemic situation of national importance” on November 25th. But: He explained to the traffic light parties in a letter how the corona measures can be extended without the announcement of the corona emergency (BILD reported). Spahn’s reasoning: “The epidemiological situation confirms the further necessity of these measures this autumn and winter.”

For this, the Infection Protection Act must be changed in such a way that the epidemic emergency as a prerequisite for corona measures is deleted!

In other words: Even without a declared emergency, restrictions would continue to exist.

That is what the SPD, Greens and FDP apparently want to do. The traffic light parties are currently speaking with the other parliamentary groups in the Bundestag as well as with representatives of the federal states and the incumbent federal government. Objective: to decide on the change in the Bundestag in November – before the “epidemic situation” expires.

SPD parliamentary group leader Rolf Mützenich (62) said yesterday in the Bundestag that the states should be able to react to increasing numbers of infections with various measures. This is what they want to “map in the Infection Protection Act”.

Top lawyer Prof. Josef Franz Lindner (55, University of Augsburg) warns in BILD: “That could mean: Corona measures forever!” The massive restrictions (e.g. 3G rule) would thus be resolved by the pandemic special situation that has always been the case up to now served as justification for the measures. “This hurdle has now been removed,” says Lindner.

This is “a significant tightening” of the legal situation.
