“The actions of the member of the Seimas of the Republic of Lithuania Remigijaus Žemaitaitis (…) contradict the Constitution of the Republic of Lithuania. With these actions, the member of the Seimas of the Republic of Lithuania, Remigijus Žemaitaitis, broke his oath and grossly violated the Constitution of the Republic of Lithuania”, states the CT conclusion, which was denounced by CT chairman Gintaras Goda.

This conclusion of the CT is final and non-appealable.

After the court’s decision, the parliament should make decisions regarding the annulment of the mandate of R. Žemaitaitis as a member of the Seimas.

ELTA reminds that the Constitutional Court considered the issue of R. Žemaitaić after the parliament decided to start the impeachment against R. Žemaitaić. According to the assessment of the Seimas special investigation commission, R. Žemaitaitis in 2023. published anti-Semitic, national discord-inciting posts on the Facebook social network and public information tools, and with such actions, possibly broke the oath of a member of the Seimas, grossly violated the Constitution.

R. Žemaitaitis repeatedly outraged the international community with his anti-Semitic statements. The politician accused the Jews of having carried out the “Holocaust of Lithuanians”, publicly shared potentially anti-Semitic statements.

The General Prosecutor’s Office has started a pre-trial investigation into the MP’s anti-Semitic statements.

As stipulated by the Seimas statute, if the parliamentarians decide that there is a basis for impeachment of a politician, the Seimas must apply to the Constitutional Court to assess whether the Constitution has been violated and the oath taken has been broken. If the Supreme Court finds that the oath was broken, the mandate of a member of the Seimas can be revoked if 85 members of the Seimas vote in favor.
