Pediatricians Challenge Vaccine Schedule Changes in Federal Court

A lawsuit filed by the American Academy of Pediatrics (AAP) against the Department of Health and Human Services (HHS) over alterations to the childhood vaccine schedule and advisory committee is currently under consideration by a Boston federal judge. The case stems from concerns regarding changes initiated following the appointment of Robert F. Kennedy Jr. and has rapidly evolved beyond its initial focus.

Judge Brian E. Murphy concluded a full day of oral arguments in a packed courtroom but did not issue a ruling from the bench. Instead, he requested additional information from the government’s legal team before determining the legality of the recent modifications. Specifically, the judge asked the Department of Justice (DOJ) to respond to declarations submitted by the plaintiffs the evening before the hearing, including a statement from Susan Kressley, the immediate past president of the AAP. The DOJ has until the end of Wednesday to submit its response.

The initial legal challenge was prompted by an announcement made by Kennedy via a video posted on X (formerly Twitter) regarding the removal of COVID-19 vaccines from the recommended childhood immunization schedule. It now includes challenges to Kennedy’s restructuring of the advisory panel that provides guidance to the Centers for Disease Control and Prevention (CDC) on vaccine policies, as well as objections to the revised vaccine schedule published in January.
