The judges of the VII criminal section of Milan rejected the requests of the defenses of the former Olgettines, accused in the case with Silvio Berlusconi, who through the lawyers had asked immediate acquittal, before the end of the trial, from accusations of perjury, contested together with corruption in judicial acts. Instances that were based on the ordinance with which the college on November 3 declared unusable the minutes of the depositions of 18 young people, given in the Ruby and Ruby bis trials.
According to the panel, taking into account “the advanced but not completed state of the investigation”, ie the hearing, “The evidence requirements do not exist” to apply Article 129 of the Code of Criminal Procedure which provides, given certain conditions, the obligation of a “declaration” of immediate acquittal, even before the end of the trial. The trial goes on for everyone and for the two alleged crimes, including corruption in judicial acts.
