Workers who become unemployed have the right to receive unemployment benefits if they have worked for more than one year, or a subsidy when they have not completed that period.

This right can be suspended for different reasons, such as moving residence abroad for a period of less than one year to search for or carry out a job. Also when the person receiving the benefit becomes maternity or paternity. Or if you work as a self-employed person for a certain period of time.

The benefit or subsidy can be resumed, taking into account that there is a deadline and procedures that must be complied with. If it was suspended due to a sanction after having committed a minor or serious infraction of those classified by law, the resumption will be carried out ex officio by the State Public Employment Service (SEPE) once the punishment period has elapsed. Provided, of course, that the benefit or subsidy has not been exhausted and the beneficiary is registered as a job seeker.

In other cases, the corresponding request must be submitted within a period of 15 business days following the end of the reason for which the payment was suspended, provided that the person is legally unemployed, has registered as a claimant for employment, and has reactivated the activity agreement.

This agreement, which must always be in writing, establishes the rights and obligations of both the public employment services and the worker to increase their employability.

The resumption of collection will occur after the suspension cause ends. The beneficiary will collect unemployment benefits again for the remaining period -except in cases of sanctions-, and with the regulatory basis and the corresponding percentage when the suspension occurred.

In the event that the request is submitted after the deadline, the collection will resume from the request. As many days of benefit will be consumed as those that have elapsed between the date on which it would have been resumed – if it had been requested within the deadline – until the day before the application is submitted – in the case of contributory benefit – or until the same day – for unemployment benefits.

How to request it

Through the Internet, in the electronic headquarters of the SEPE, as long as you have a digital certificate, electronic DNI or cl@ve username and password.

You can also request it in person at a benefits office, after making an appointment at the SEPE electronic headquarters, or by telephone.
