They have been languishing in prison since August 2022 for having denounced the conduct of the transition. Oumar Sylla alias Foniké Menguè, Ibrahima Diallo are still awaiting trial. It is rumored that the transitional authorities are using maneuvers devoid of any legal basis to keep these FNDC officials in prison.

When is the trial of Foniké Menguè, Ibrahima Diallo and Saïkou Yaya Barry? Very clever whoever answers to answer it. The activists of the National Front for the Defense of the Constitution (FNDC) have been in detention since they organized the demonstration of July 28, 2022, to denounce the solitary management of the transition by the CNRD. Since then, they and their lawyers have been fighting like hell to get their trial started. The collective of FNDC lawyers knocked on all the doors, the detainees observed a death from hunger. In vain. They are still languishing at the five-star hotel in Coronthie.

Before their arrest warrant, the three members of the FDNC had been charged by the TPI prosecutor’s office in Dixinn for “looting, arson, destruction of property, criminal assembly, disturbance of public order”. Charges attacked immediately before the Court of Appeal of Cona-crime. Last November, an examining magistrate takes a partial dismissal order, returns the concerned before the correctional court of Dixinn for judgment. He clearly dismisses the charges that could lead them to the criminal court and retains only “illegal assembly on the public highway, complicity in the destruction of private and public buildings and complicity in intentional assault and battery”. Charges that suggested that a trial would quickly be held. But the public prosecutor’s office is appealing the decision. From there, it’s a game of ping-pong that settles into the procedure. The Advocate General who is managing the file for the prosecution asks, to everyone’s surprise, to confirm the decision of the investigating judge: “It appears from my analysis that the dean of the investigating judges, by issuing a restraining order partial place, made a good appreciation of the law. We request that the president of the second Chamber of control of the instruction please confirm this order”. This Chamber follows the requisitions of the Advocate General. Against all expectations, the Attorney General disavows his Advocate General and appeals against the order. Except that the letter of appeal never reached the registry of the Supreme Lower Court. It would have been forgotten at the registry of the Court of Appeal. Clearly, this Court is not formally seized. His registry had to come out of the woodwork for the public prosecutor’s office to recognize his blunder: “We inform you that there is no appeal».

These trial and error cost Foniké Menguè and company nearly five months of additional detention, when they could have been tried since last November. Add to this that they would now be detained beyond the time limits prescribed by law. Meanwhile, their lawyers, convinced of the appeal of the general prosecutor’s office, continued to denounce the slowness of the Supreme Lower Court. At the public prosecutor’s office currently, it is radio silence. He is surely counting on the Supreme Lower Court to remove a thorn from his side, in order to be able to open the trial.

Foniké Menguè and Ibrahima Diallo continue to languish in the gnouf. Saïkou Yaya Barry, released to seek treatment abroad, now lives in exile.

It should also be remembered that Mamadou Bilo Bah, in charge of the FNDC branches and mobilization, has also been languishing in the gnouf for several months.
