The main objective of the reform, promoted by Morena in Mexico City, is to modify the procedure for the ratification of the head of the Prosecutor’s Office, which could benefit the now incumbent, Ernestina Godoy, in his bid to remain in office for another four-year term.
Court validation and modifications in the ratification process
The project of the rapporteur minister, Juan Luis González Alcántara-Carrancá, received the approval of the SCJN, supporting the decree published on May 17, 2023. As of this reform, the ratification procedures have been modified for various figures within the local Attorney General’s Office, as well as the powers of the Citizen Judicial Council.
During their analysis, the Ministers determined that the local Congress had the freedom to configure its own justice administration institutions, without violating legislative processes.
