New Delhi: The Supreme Court, the country’s highest court, on Tuesday heard applications seeking a stay on the implementation of the Citizenship (Amendment) Rules, 2024, and asked the central government to respond within three weeks. Solicitor General Tushar Mehta, appearing for the Centre, told the court that they needed four weeks to respond to the 20 applications. These applications have urged that the related rules should be stayed till the top court disposes of the petitions challenging the constitutional validity of the Citizenship (Amendment) Act (CAA), 2019. Mehta told the bench that it ( CAA) does not take away the citizenship of any person. Four years after the controversial law was passed by the Parliament, the Center had paved the way for the implementation of the Citizenship (Amendment) Act, 2019 with the notification of related rules on March 11. The Citizenship Amendment Act (CAA) aims to protect persons seeking refuge in India due to religious persecution. This provides them a shield against the act of illegal migration. In the CAA, the rules of citizenship have been made easier for immigrants of Hindu, Sikh, Buddhist, Jain, Parsi and Christian religions from Afghanistan, Bangladesh and Pakistan. Earlier, to acquire Indian citizenship, it was mandatory for a person to live here for at least 11 years. By simplifying this rule, the period for acquiring citizenship has been increased from one year to 6 years. In simple words, the rules for granting citizenship to non-Muslim immigrants from India’s three neighboring countries Pakistan, Afghanistan and Bangladesh have been simplified.
