Chilean Senator-Elect Faces Fraud Investigation After Supreme Court Ruling

The Supreme Court’s decision to allow a fraud investigation to proceed against Miguel Ángel Calisto Águila casts a shadow over his recent election victory and raises questions about Chile’s political landscape.
Just days after securing a senate seat for the Aysén region, senator-elect Miguel Ángel Calisto is confronting renewed legal scrutiny. The Supreme Court has upheld a decision authorizing an investigation into allegations of treasury fraud, stemming from irregular payments made to a former advisor, Carla Graf, and other collaborators. The ruling, delivered in a majority decision, confirms the plausibility of the accusations and allows the Public Ministry to continue its inquiry.
Supreme Court Cites Evidence of Irregularities
The court’s decision centers on evidence presented by the prosecution, which suggests a pattern of questionable financial activity. Key findings include a lack of documented reports detailing the work of parliamentary advisor Carla Graf toledo, coupled with statements from five other advisors who claim to have no knowledge of her role. Further fueling the investigation is the apparent incompatibility between Graf’s stated work schedule as a professor and the time allocated for advising, alongside money transfers to Calisto and his associates that coincide with Graf’s fee payments.
According to the court, this preliminary evidence meets the necessary parameters for forming a case. “The facts gathered meets the parameters of preliminary conviction required for the formation of a case, without prejudice to what is resolved in the judicial process,” the court stated.
Defense Arguments Dismissed as Premature
Calisto’s defense team argued that graf provided strategic advice that did not require formal written reports,and that the financial transfers represented legitimate loans or payments for construction work. However,the Supreme Court persistent that these explanations are matters for a full criminal trial to assess,not for dismissal at this preliminary stage. The court emphasized that the seriousness and plausibility of the investigation warranted its continuation.
The resolution has been officially communicated to the Chamber of Deputies, adhering to constitutional and procedural requirements.
A Controversial Victory and Uncertain Future
Calisto secured the highest percentage of votes – 32% – in the Aysén region on Sunday’s elections, guaranteeing his Senate seat starting March 11, 2026. However, his candidacy was already marked by controversy due to the ongoing investigation into alleged fraudulent use of parliamentary funds, including potential diversions of money and the purchase of land using public resources.
Despite the investigation, Calisto may still be sworn into office. Chilean law stipulates that parliamentary jurisdiction is renewed upon taking the oath of office, meaning the investigation does not automatically disqualify him – unless formal charges are filed by the Public Ministry before the new legislative period begins.
Balancing Act in the Upper House
Calisto’s political alignment remains unclear. While elected through a quota designated for the FRVS (Frente Regionalista y Verde Social) coalition, it is indeed uncertain whether he will align with the Democrats or lean towards the left. His vote could prove crucial in balancing the power dynamics within the Upper House. Historically, Calisto was affiliated with the DC (Democrat Christian party) until 2022 and is widely considered an unpredictable vote in Congress, having previously supported accusations against right-wing politicians.
The parliamentarian has consistently emphasized his commitment to regional interests,prioritizing “territorial compensation for Aysén” over strict party loyalty.
