The emotional toll on the surrogate mother, particularly the psychological impact of relinquishing a baby she has carried for nine months, is also a significant point of contention.

Medical Reasons Behind Artists’ Choice of Surrogate

Surrogacy has become increasingly common in Hollywood. Kim Kardashian openly shared that she used a surrogate for her third and fourth children due to placenta accreta, a serious medical condition where subsequent pregnancies could be life-threatening. Priyanka Chopra and Nick jonas also chose surrogacy to welcome their daughter, and Paris Hilton’s recent experience has also drawn public attention. For these couples, surrogacy offers a path to parenthood when faced with fertility issues, medical trauma, or significant health risks, allowing them to have a child genetically related to them.

Questioning the Surrogate Mother

The American Society for Reproductive Medicine (ASRM) classifies modern surrogacy into two main types: traditional and gestational. The gestational type, now the most prevalent, involves no genetic connection between the surrogate mother and the baby. Instead, eggs and sperm-from the biological parents or donors-are implanted into the surrogate’s uterus via in vitro fertilization (IVF). Essentially, the surrogate provides a “place” for the fetus to develop.

Legal status – Surrogacy is illegal in Indonesia under Law Number 17 of 2023. Assisted reproductive technologies are limited to married couples, and implantation must occur in the wife’s womb. Agreements involving another woman’s womb are unenforceable.

Surrogacy is strictly prohibited under Indonesian law. law Number 17 of 2023 concerning Health stipulates that assisted reproductive technologies are only permitted for legally married couples, and any resulting fertilization must be implanted into the wife’s womb. Using another woman’s womb, even with a contractual agreement, is considered illegal and unenforceable.

This legal framework means that even if a commercial agreement is in place, surrogacy arrangements are not legally recognized in Indonesia.
