At the management meeting that convened today (Wednesday) it was determined that workers will go on sick leave and competitions that cannot finance themselves will be canceled. At the same time, it was decided by associations from Maccabi and Po’el to call an extraordinary general meeting in an attempt to examine the mandates committee’s decisions and resolve the crisis, all while the court proceedings are ongoing.

Following the non-approval of the 2022 financial reports by the deadline set by the government ministries, which may lead to the denial of approval for proper management and the halting of the flow of public funds to the union – the management of the swimming union met and decided on a series of extreme measures that actually lead to the cessation of activity.

First, the management determined that all union workers would go on furlough, except for workers essential to the operation of the Olympic programs who would go on furlough only in about a month. In its decision, it was determined that an employee who refuses to go on sick leave will be invited to a hearing before dismissal.

In addition, it was determined by the management that all activities of the swimming association – including training, competitions and enrichment activities – will be suspended until further notice, unless they are activities that can finance themselves. The chairman of the union Miki Halika wants to hold the Israeli championship next month despite these decisions, but it is doubtful whether this will be possible in the current situation and it is possible that the participation rates will be higher in order to hold the event.

In the meantime, the union will contact all Maccabi associations that objected to the approval of the 2022 financial statements to check why they did so and whether corrections are required. Also, the union decided to hire an organizational consultant who will work to obtain exceptional approval from the state to postpone the submission of the financial reports so that there will be time to resolve the crisis and approve the reports anyway.

At the same time, another dramatic decision was made according to which the union will hire a legal advisor who will prepare a detailed opinion for the management on the damage and its economic scope, where, among other things, he will give his opinion on whether there is a reason to open legal proceedings for the violation of the fiduciary duty of the members of the management.

Even before the management meeting, associations from Maccabi and the Po’el yesterday asked for an extraordinary general meeting to be held in order to resolve the management crisis in the union. The associations intend to appoint a panel of three arbitrators – which includes the CAS arbitrator Adv. instead of the mandates committee.

Behind the demand for the existence of the non-quorum general assembly are the Hapoel Emek Jezreel, Emek Hefer, Ashdod swimmers, Maccabi Haifa Carmel and Kiryat Bialik associations who signed the document. An official in the management said: “After the unions on both sides demanded to check this and hold a neutral count, it is a vote of no confidence in the management of the union.”

At the same time, it is not clear whether this move is legal and possible, because there is currently an appeal submitted to the Mandates Committee and a petition process is underway at the swimming association’s court regarding the decisions of the Mandates Committee, so it is doubtful whether such a discussion can even be held in the general assembly in terms of legal law. According to the statutes, the authority to determine the composition of the mandates committee rests with the management. Officials in the associations said about this: “There is a lack of trust in the management and the mandates committee, they want external lawyers to count the votes.”
