The Specialized Regional Chamber of the Electoral Tribunal of the Judicial Branch of the Federation determined that Xochitl Galvezpresidential candidate of the Fuerza y ​​Corazón por México coalition, did not violate the rules of electoral propaganda or the principles of certainty, legality and equity in the contest with a publication in X in which she proposed to the INE to carry out a campaign on social programs which included the logo of the Institute.

By majority, the Plenary indicated that the purpose of this publication was not to promote the candidate’s electoral platform, but rather to inform about the request to carry out a campaign on the use of social programs for electoral purposes, presented to the General Council of the INE.

It also determined that this content did not generate confusion among citizens, because it was not false information, but rather issues anchored in public debate and, therefore, protected by freedom of expression.

Given the non-existence of the infringement attributed to Galvez Ruiz, PRI, PAN and PRD did not fail in their duty of care.

In a public session, the Plenary also determined that the president, Andrés Manuel López Obrador, violated the principles of impartiality, neutrality and equity and improperly used public resources, derived from demonstrations at the morning conference on February 1, 2024.

At said conference, the President issued expressions of an electoral nature, which departed from what institutional communication represents.

In turn, it was determined that he failed to comply with the precautionary measures in their preventive protection aspect, because he issued expressions of an electoral nature despite the fact that the Complaints and Complaints Commission of the INE ordered him to abstain.

The head of the federal Executive cannot be sanctioned for electoral violations, he can only be held responsible, in accordance with criteria established by the Superior Chamber of this court.

The Plenary also determined that the general coordinator of social communication and spokesperson for the Government of the Republic, Jesús Ramírez Cuevas; the general director of digital communication of the Presidency, Jéssica Ramírez; the head of the department assigned to the aforementioned communication coordination, Pedro Ramírez Pérez, as well as the director of the Center for the Production of Informative and Special Programs, Sigfrido Barjau de la Rosa, violated the principles of impartiality, neutrality and equity and improperly used public resources, because these people were responsible for the organization, production and dissemination of the reported press conference.

In these cases, it was determined to give a hearing to the Internal Control Body of the Presidency of the Republic to determine what is legally appropriate.
