Musheika was charged with minor health impairment (according to the degree of injuries, this corresponds to moderate physical injury) – after gathering evidence, the criminal case was transferred to court.

The Kaunas district court, taking into account the clean biography of the 16-year-old before the beating, his confession, apology and regret for his actions, decided on Wednesday to release him from criminal responsibility and closed the case.

It is true that the family of the student who did not control his fists will have to compensate the victim in the amount of 1200 euros in non-pecuniary damage.

During the process, the beaten boy and his parents asked for a higher non-pecuniary damage of 1,500 euros.

A fight broke out in the school corridor at the start of the school year in September 2023.

The defendant explained that his peer pushed him at first, and then he lost control: “I hit accidentally out of instinct.”

At the same time, the musheika stated that he considers his actions bad and sincerely regrets them.

In the past, he had not caused trouble for educators, and there is no evidence that he has been violent against other minors.

In her closing speech, the prosecutor agreed with the fact that there are grounds for exonerating the 16-year-old from criminal responsibility.

The prosecutor’s office requested to apply a measure of criminal impact to the accused – a warning, which the court agreed with.

If the ten-year-old commits a new crime during the period of validity of the warning, the exemption from responsibility will accordingly expire and his biography will be “decorated” with a conviction.
