The administrators of Girona estates warn that the new Housing Law will not generate more rental offers

He College of Estate Administrators of Girona believe that the new Housing Law it will not achieve the intended purpose of increasing the rental offer and they warn that it “confronts” the right to housing and private property. “We think that with the regulation and measures proposed by the new ‘Law’ it will not be possible to provide the market with a greater supply of rental housing”, says its president, Francisco Quintana. In this regard, he says that his “fundamental concern” is related to housing leases and to most of his clients, the small owners, who “have allocated part of their savings to investment in property and who have a generation of income derived from the investment to maintain them”.

The college, which is working on the analysis of the new law, states that they do not want to remain apart “from social reality”, which makes “clear” the lack of housing both in terms of social as in affordable rent.

On the other hand, they are also concerned about the regime for determining the stressed market areas, in which the autonomous communities will make decisions in this regard and which Catalonia is already working on.

“Precisely, Catalonia was already a pioneer in the application of these tense areas, prior to the validity of the current law, and surely the resulting data do not invite optimism regarding the real results for the rental market , derived from the application of the rental income limitations”, regrets Quintana.

From 60 to 143 municipalities

This Thursday, the Government began the process to expand from 60 to 143 the number of municipalities considered to be stressed areas where the limitation of the rental price provided for by the Housing Law (12/2023) will have to be applied. In this list of municipalities there are up to 16 towns in the Girona counties: Blanes, Lloret de Mar, Sant Feliu de Guíxols, Palamós, Palafrugell, la Bisbal d’Empordà, Girona, Salt, Sarrià de Ter, Santa Coloma de Farners, Porqueres, Banyoles, Olot, Ripoll, Figueres and Puigcerdà. In total there are up to nine municipalities more than in the previous list.

Rent goes up by 12.3%

According to the latest data from the real estate portal Fotocasa for the month of May, the price of rent in the regions of Girona is up to 12.3% more expensive than a year ago. In the last month, renting a flat has become more expensive by 2.3%, while in Girona city the price of rent has increased by 8.9% in the last 12 months.

Concerned about occupations

Another aspect that worries administrators has to do with occupations. In this sense, they say that they are observing “disenchantment” in how the modifications in procedural matters referring to judicial actions for eviction, for lack of payment, end of the contractual period or, even, in the case of illegal occupations, “make it very difficult to quickly and effectively obtain judicial resolutions that allow the owner to regain possession of the property”.

“We note again a lack of legal certainty, which we think would be the most effective measure so that the confidence of the owners in the rental market, facilitate a greater supply and, possibly, a natural regulation of prices, since the market would have enough rental housing to meet the demand for housing,” adds Quintana.

Finally, they regret that they have not been listened to by the professionals in the sector when it comes to regulating an area such as housing.
