The Administrative Court of Public Procurement of the Community of Madrid (TACP) has rejected the appeal presented by PreZero for having been eliminated from the procedure for the award to one of its competitors, Urbaser, of the concession for waste treatment in the north-west of Madrid , valued at more than 1,000 million euros.
According to the minutes of the public tender consulted by Europa Press, the TACP did not issue any sanctions against PreZero, having not appreciated the presence of bad faith or imprudence in presenting this appeal. This resolution means lifting the suspension of the procedure decreed on November 28, since the appeal has already been resolved, which implies that the awarding of the largest concession of this type of contracts in Spain to Urbaser will continue.
The offer from Urbaser, controlled by the American Platinum fund, was selected on November 5 after presenting the best quality/price ratio compared to the other four offers launched by Valoriza (Morgan Stanley), FCC-Acciona, Espina-Setec and Prezero ( former Cespa and now Schwarz Group).
The latter company filed a special appeal on November 18 against the agreement of the Northwest Commonwealth contracting table to exclude Prezero from the tender for “exceeding the maximum bidding budget or the maximum period indicated for the execution foreseen in the contract”. Faced with this appeal, the TACP decided 10 days later to suspend the proceedings, thus accepting Prezero’s request to apply precautionary measures and prevent the final sentence from taking place before the resolution of the appeal. However, the appeal has already been rejected and the suspension has been lifted.
The contract, awarded for 1,091 million euros, includes the concession of the works for the construction and management of the environmental complex of Colmenar Viejo, as well as the management of the set of infrastructures for the treatment of waste of the Community of Municipalities of the Northwest, with a concession period of 20 years. In addition to Colmenar Viejo, this community operates in 75 other municipalities in the north-west of Madrid. This contract is financed with European funds from the Recovery, Transformation and Resilience Plan.
The suspension of this macro bonus for Urbaser, now revoked, came at a critical moment for its shareholders, who are immersed in a sale process. Platinum is currently negotiating with several major international funds to sell the company. The transaction is expected to be close to 5,000 million euros.
