At its last meeting, the government decided to send to the Constitutional Court the decision by which the Parliament obliged the Minister of Finance to find BGN 1 billion for the “Security of the Electricity System” fund. It was taken on March 21, and the billion had to be transferred by the 31st of the same month.
The fund must pay compensations to electricity distribution companies and households in case of high electricity prices. The government found a solution to the case with the money for compensation for domestic consumers. It decided that the state should assume the BGN 1.6 billion debt of the capital heating system to BEH and Bulgargaz, and BEH would donate over BGN 700 million to the fund.
On Wednesday, the ministers decided, however, that the decision of the parliament contradicted six articles of the constitution. Among them are those that there is a separation between the executive, legislative and judicial powers. The powers of the National Assembly were to adopt the state budget, but not to determine how to spend the money from it, and this was done by decisions of the Council of Ministers.
During the debates in the parliament, upon adoption of the decision by GERB, it was pointed out that 5 billion were seized from the energy industry in three years and it is proper that the 1 billion deficit be covered so that the fund has funds for compensation after the liberalization of the wholesale market from 1 April. The PP-DB stated that the deficit is due to a decision of KEVR, which set higher prices for quotas for carbon emissions and electricity.
