The case of a Renaissance MP illustrates the ethical vagueness of the Assembly around conflicts of interest

At the National Assembly, the rules governing conflicts of interest are subject to interpretation. The case of Marjolaine Meynier-Millefert, Renaissance MP for the tenth constituency of Isère since 2017, has just offered a demonstration of this. The elected official is implicitly referred to in the activity report of former ethics officer Christophe Pallezpublished Wednesday, May 24, as noted by the site Context. But according to our information, his successor, Jean-Eric Gicquel, draws an opposite interpretation from the case of the deputy. The first considers that she holds voluntary functions incompatible with her mandate as a member of parliament, while the second sees no problem there.

Vice-president of the commission for sustainable development and regional planning, Marjolaine Meynier-Millefert has been active in matters related to energy renovation since her first mandate. In March 2021, she was appointed president of the HQE-GBC Alliance, a non-profit association, recognized as being of public utility, which brings together building professionals and promotes sustainable construction.

The HQE-GBC Alliance is officially registered in the directory of interest representatives of the High Authority for the transparency of public life (HATVP) for his lobbying actions. For example, in 2021 it declared that it would intervene with the government to “participate in updating regulatory texts related to the use and verification of environmental data”.

In his report, the former ethics officer Christophe Pallez targets this situation, without explicitly naming it, noting that the electoral code “prohibits any MP from carrying out the activity of interest representative” for lobbies declared to the HATVP. According to him, it follows that “the presidency, even voluntary, of an association having the status of interest representative, seems incompatible with the parliamentary mandate”.

His analysis has no direct consequence, the assessment of the incompatibilities of activities being the responsibility of the Assembly delegation responsible for applying the status of deputy. So far, the body, chaired by the elected Caroline Fiat (La France insoumise), has not asked Marjolaine Meynier-Millefert to renounce the presidency of the HQE-GBC Alliance.

The former ethics officer, on the other hand, considers that, even in the event that such a function is deemed compatible with the parliamentary mandate, the elected representative concerned should “prefer deportation” during parliamentary proceedings “likely to interfere with the interests of the association in question and its members”. Or, Marjolaine Meynier-Millefert was appointed co-rapporteur in March a mission on the energy renovation of buildings.
