The investigating chamber of the Aix-en-Provence Court of Appeal (Bouches-du-Rhône) canceled, Wednesday, July 27, the judicial review of the Parisian criminal lawyer Pascal Garbarini. This criminal, heavily paralyzed following a motorcycle accident in 2003, is suspected of being the leader of this gang which, since the beginning of the 2000s, has imposed itself in the criminal landscape of Ajaccio and its region. . Extortion, racketeering, assassinations and attempts, money laundering, drug trafficking, this gang, most of whose members are now in pre-trial detention, is reputed to be one of the most formidable in Corse-du-Sud.

By canceling the judicial control measure which prohibited the lawyer from contacting his client and the other people implicated in this case, the investigating chamber followed the requisitions of the general prosecutor’s office. This pointed out that “the elements that founded the indictment of the head of the criminal association of Pascal Garbarini result from the interception of the conversations he may have had with Jacques Santoni in the latter’s Paris apartment, on November 13, 2019 and November 25 2019”. According to the public prosecutor’s office, in view of these elements put forward by the judges of the JIRS, the indictment on the grounds of criminal association is not sufficiently substantiated.

In its reasons, the investigating chamber takes almost word for word the arguments formulated in the requisitions. The magistrates of the Court of Appeal write in particular: “The elements retained by the investigating judges during the indictment of Pascal Garbarini and within the framework of their order of placement under judicial control in order to describe the serious and concordant indications which would make the commission by the involved in the offense of criminal association with a view to preparing an offense punishable by ten years’ imprisonment, appear insufficient. »
