After nine difficult negotiation sessions, and despite the tight requirements of the framework document set by the government, the employers and at least two unions (the CFDT and the CFTC) reached Friday evening, November 10, at a ” protocol of agreement “ on unemployment insurance, making it possible to save the rules of paritarianism at the last minute.

If the Ministry of Labor considers that its requirements have been met, it will be able to ratify the agreement, which the CGT and CFE-CGC refused to sign. Here are the new compensation rules which will be applicable from January 1, 2024.

► Rights opening conditions

To register for unemployment insurance for the first time, you must have worked at least five months, not six months, over the last 24 months. The unions wanted to return to four months. The minimum compensation period is set at five months (compared to six currently).

To better secure the situation of seasonal workers on the labor market, they must also have worked five months to be compensated and their minimum duration of compensation will also be five months.

► Degression

The degression of unemployment benefit, which concerns those who receive a daily allowance greater than €91.02 per day (corresponding to a gross salary before loss of job of €4,850), will no longer be applied from 55 years, compared to 57 years until now.

Refusing to sign the agreement, the CFE-CGC executives union, supported by other organizations, demanded the elimination of the degression.

► Seniors

The text refers the provisions concerning compensation for seniors (in particular the raising of the age limits for an extended duration of rights) linked to the pension reform to the future dedicated negotiation which should open soon.

But it already specifies the volume of savings to be made: 440 million euros over the period 2024-2027, a point criticized by several unions, including the CGT which sees it as “a form of tartuffery”. “The end of careers paid by unemployment insurance are over”rejoiced Éric Chevée (CPME), targeting both the companies and the employees concerned.

► Monthly payment

The allowance paid will be the same each month, based on 30 days. Over a full year, the unemployed will lose five days of compensation, and even six in leap years. But these days saved will extend by as many days the rights of those who are reaching the end of their compensation period.

It’s about a “new form of payment of rights”explained CFDT negotiator Olivier Guivarch. “It’s a reduction in rights”, judged his CGT counterpart Denis Gravouil. According to employers’ calculations, the measure would bring in 950 million over four years for Unédic.

► Business creators/buyers

For job seekers who create or take over a business, the text provides for provisions to limit “windfall effects”. The measure should bring in 870 million over four years.

► Reduction in employer contributions

The employer contribution for unemployment insurance will increase from 4.05% to 4% of gross salary, via the elimination of a temporary exceptional contribution put in place in 2017. The cost will be 1.5 billion euros over four years for the unemployment insurance system.

► Bonus-malus

This system aims to limit the use of short contracts. Employers’ contribution to unemployment insurance is modulated according to their use of these contracts, compared to the average for their sector. The text restricts the type of end of contract subject to the bonus-malus and only takes into account the end of contract lasting less than one month, a measure demanded by employers.

► Status quo for intermittent workers

The agreement provides for the maintenance of current compensation rules. It therefore rejects the progress obtained by a sectoral agreement negotiated on October 27. The employers initially wanted to reduce the compensation conditions for technicians and artists in the entertainment professions by 15%.
