The National Court Prosecutor’s Office has opened proceedings to investigate whether Naturgy manipulated the electricity market after a complaint from Facua. In a statement, the agency ensures that the objective is to determine the scope of this complaint and determine if there is a crime against the rights of consumers for “fraudulent machination to alter the price of things, which produce or may cause patrimonial damage to a generality of people in the territory.

Thus, the Prosecutor’s Office opens proceedings and agrees to request a report on energy from the National Commission for Markets and Competition (CNMC) that will address four points.

On the one hand, if the resolution of the CNMC is firm or has been challenged in court; with indication in this case of the judicial body and process. Also if the sanctioned conduct has had the effect of an increase in the final price paid by consumers and users. Information will also be requested on whether the possible increase in prices to consumers caused by the penalized conduct has been projected over all or a limited part of the national territory. And, finally, an approximate quantification of the patrimonial damages caused to consumers and users caused by the eventual increase in final prices.
