The list kept the four charges, but now takes into account the decision issued recently by the Supreme Court, which ruled that the former president has broad immunity from prosecution in criminal cases.
The new indictment is 36 pages long, while the previous one was 45 pages long, from which the sections contained in the decision of the Supreme Court, which has a conservative majority, were deleted.
But the heart of the indictment remained the same, as it pointed out that Trump lost the 2020 elections and was “determined to stay in power” anyway and tried to overturn the results afterwards.
In July, the Supreme Court ruled that former presidents enjoy broad immunity from prosecution in criminal cases for their official acts while in office.
The decision raised questions about the possibility of continuing to prosecute Trump.
Trump described the amended indictment as a “desperate act” that comes as part of what he considers a campaign of persecution against him.
The former president said in a post on his platform, Truth Social, “The ‘special counsel’ appointed in violation of the law, Jack Smith, filed a ridiculous new indictment against me, which contains all the problems of the old indictment, and . he must be dismissed immediately.”
The submission of the amended indictment comes three days before Special Prosecutor Jack Smith, who brought charges against Trump and the former president’s lawyer, is scheduled to submit a timetable for pretrial procedures.
Judge Tanya Chatkan, who presided over the trial, had set a date for an evaluation session on September 5, but it was not immediately clear whether the session would take place in time after the amended indictment was filed.
Trump’s lawyers want to postpone the trial until after the presidential elections scheduled for November 5, in which the former president will compete with Vice President Kamala Harris.
