This is a new retreat for Gérald Darmanin. Adhering to the release of terrorist groups, the Minister of the Interior saw the Council of State suspend the release of the ultra-left group Collective Defense. In April, Gérald Darmanin announced that he had identified a group called Defco which he called “rebellious” and “launched its release”. Based in Rennes, this group was founded in 2016 during the protest against the El Khomri law or the Labor law. The Breton capital was then the scene of major mobilizations throughout the attacks and devastation.

Collective Security or Defco presents itself as “an organization completely open and public, autonomous from political parties, independent of councils and assemblies”, and which assumes “a commentary on police and justice”.

Serious doubts about the law

On Wednesday, the Council of State has suspended the release in summary proceedings, considering that the Minister of the Interior did not provide sufficient evidence of the dangers to public order. The judges expressed “serious doubts about the legality” of this release order, which did not specify how Defco would incite or participate “in armed demonstrations or acts of violence against persons or property”, as provided for by law.

In its decision, the National Council declared the “necessity of an attack” on the freedom of association, the “fundamental basis” of the Republic, of the suspension, which could only be implemented to avoid “serious disturbances to the general order person”.

Previous releases have been cancelled

The Minister of the Interior, who has increased the number of release procedures since he arrived at Place Beauvau in 2020, has been hit with several snubs by the Supreme Administrative Court, which essentially canceled the release of Environment group Les Soulèves de la Terre Last year.
