The legal battle began after Burruss publicly announced her intention to divorce Tucker on November 21, citing an “irretrievably broken” marriage with a separation date of July 15, 2025. According to reports published by US Weekly on December 1, Tucker responded to the divorce petition on November 26, initiating a complex custody dispute and questioning the financial terms of their union.

Tucker’s filing asserts that their children, Ace and Blaze, are currently residing with him in Georgia, primarily to accommodate Burruss’s frequent “out-of-state work obligations.” He anticipates these obligations will continue for “at least the next several months,” leading him to request primary physical custody while proposing joint legal custody and final decision-making authority.
Despite seeking primary custody, Tucker emphasized a desire for amicable resolution. “[Tucker] wishes to make clear that he recognizes [Burruss] as a loving and capable parent and remains sincerely hopeful that prior and continued discussions between the parties will bring full resolution of all matters,” his filing reportedly stated. However, he is prepared to vigorously pursue his custody requests should an agreement prove unattainable.
Prenuptial Agreement Under Scrutiny
Adding another layer of complexity to the divorce proceedings, Tucker is also challenging the validity of the prenuptial agreement signed by the couple prior to their marriage in 2014. He alleges he was “pressured into signing it without his lawyers around,” claiming the agreement was presented to him without legal counsel despite Burruss’s team having previously communicated with his representatives regarding a potential prenuptial agreement.
According to Tucker’s legal team, these circumstances “raise substantial questions concerning the enforceability of said document.” Should the prenuptial agreement be deemed unenforceable, Tucker has indicated he may seek alimony. He maintains, however, a commitment to resolving the matter “amicably and privately to the extent possible.”

Despite the escalating legal tensions, Burruss and Tucker were observed celebrating their daughter’s sixth birthday together on November 22, with photos surfacing that suggested a cordial atmosphere. Prior to the Thanksgiving holiday, Burruss also shared plans to spend the day with Tucker and their children, indicating a continued effort to co-parent despite the impending divorce.
