Unemployment Insurance rises to R$ 1,320 from May

Workers with a formal contract when they are fired without just cause may be entitled to unemployment insurance. They may be entitled to receive between three and five installments. As of May, the amount of unemployment insurance will rise from R$1,302 to R$1,320.

This value will change due to the Federal Government’s decision to readjust the minimum wage, which is currently at R$ 1,302 and which, as of May 1st, will rise to R$ 1,320.

However, the maximum amount to be received in installments remains the same, after being readjusted by 5.95%, on January 11 of this year, based on the 2022 INPC (National Consumer Price Index), with that , the value remains R$ 2,230.97.

Who is entitled to unemployment insurance?

Formal workers who were involuntarily dismissed (without just cause) and who:

a) they do not have enough income of their own to support themselves and their families.

b) received wages from a legal entity or an individual equivalent to it, relating to:

at least 12 months in the last 18 months immediately prior to the date of waiver, upon first request; or

at least 9 months in the last 12 months immediately prior to the dismissal date, when the second request is made; or

each of the 6 months imediately prior to the date of waiver, when other requests

c) they do not receive any social security benefit of continued provision, with the exception of accident assistance, supplementary assistance and allowance for permanence in service.

Unemployment insurance covers the following classes of workers:

  • Registered worker, including domestic servants;
  • Professional fisherman (during the closed season);
  • Workers rescued from situations of slavery or similar;
  • Worker whose employment contract was suspended to take a qualification course provided by the employer.

How many installments will I receive?

According to the unemployment insurance rules, you can receive the installments according to the time of work in the company in which the respective dismissal occurred. In this case, when you earn the right to request the benefit, it must be paid for a minimum of 3 months and a maximum of 5.

  • Insurance of 3 monthly installments: paid to beneficiaries who have complied with the minimum period of service required, being 12 months (1st request), 9 months (2nd request) and 6 months (3rd request);
  • Insurance of 4 monthly installments: paid to beneficiaries who worked for a period between 12 and 23 months;
  • Insurance of 5 monthly installments: paid to beneficiaries who worked for a period of at least 24 months.
