A revolution in traffic law enforcement has come with the incorporation of visual evidence from social networks and the media. Videos that capture violations in real time have become a powerful tool for highway authorities.

The Ministry of Transportation has given the green light to this innovation through a resolution that allows the use of videos as evidence to identify responsible vehicles, the place and the exact moment in which the violation was committed. According to Álvaro Sarmiento, coordinator of the Administrative Area of ​​the Legal Office of the Faculty of Jurisprudence of the Universidad del Rosario, this evidence can be formally incorporated to issue summonses, as established by Resolution 20244000000157 of February 16, 2024.

To guarantee the validity of this new modality, transit organizations and authorities must make public on their websites the email addresses where the evidentiary material can be sent. Furthermore, the importance of the technical aspect of the video as evidence has been emphasized, especially in cases where the driver’s behavior cannot be clearly determined.

It is important to highlight that this mechanism is not a photo summons, but rather provides the necessary evidence to begin the infringement process with all procedural guarantees. The Ministry of Transportation will provide a technological mechanism for the reception and monitoring of these recordings, thus ensuring efficient and transparent management.

This measure, supported by the National Traffic Code and Decree 087, demonstrates the State’s commitment to protecting people’s rights and road safety. Those allegedly responsible will have the opportunity to exercise their rights and clarify their situation before the corresponding authorities.

In short, this new tool marks a milestone in the application of traffic law, promoting greater responsibility and safety on our roads.
