THIRUVANANTHAPURAM: The Chief Judicial Magistrate (CJM) has asked the Central Bureau of Investigation (CBI) why the Balabhaskar’s mobile phone was not sent for scientific examination when the chargesheet was filed in the Violinist Balabhaskar accidental death case.

The case was adjourned to July 5 to hear the CBI’s explanation. Balabhaskar’s family and Kalabhavan Sobi’s family filed a petition in the CJM court seeking further inquiry into the case.

The court asked whether the non-submission of the inspection report was the fault of the CBI. The CBI counsel replied that there was no need for information on the mobile phone to find evidence when investigating the case. But the court said more clarification was needed.

The plaintiffs had told the court that the CBI had turned a blind eye to the crucial evidence. Critical witnesses were deliberately left out. The lie detection test conducted by the CBI is not legal. The plaintiffs also told the court that the Supreme Court had ruled that false test results should not be accepted as evidence. According to the CBI, the chargesheet was filed after investigating all possible avenues in the case. The CBI has found that Arjun, the lone accused in the case, was negligent in driving.

The accident happened on the morning of September 25, 2019. The accident took place near the CRPF camp at Pallippuram, Thiruvananthapuram on the way to Thiruvananthapuram from Thrissur. Balabhaskar’s wife Lakshmi and driver Arjun were injured in the accident. Her daughter died at the scene and Balabhaskar was undergoing treatment.
