Kınık Demir was initially sentenced to just 4 years and 2 months in prison on May 26,2025,a decision widely criticized as lenient given the severity of the offense. She had been detained for only one night despite facing a potential sentence of up to 15 years. A Forensic Medicine Institute report submitted to the Istanbul Anatolian 8th High Criminal Court persistent that Kınık Demir was primarily at fault in the accident. Despite pleas from the Barlasçeki family and their legal representatives, the court did not initially order her arrest.

The initial sentence also included a two-year confiscation of Kınık Demir’s driver’s license and the continuation of existing judicial control measures. However,the relatively short prison term and lack of immediate detention fueled public anger and a sense of injustice.

Appeal and Court Decision

The decision was promptly appealed by Hasret Doğan, the mother of both Zehra Kınık and Batın Barlasçeki. on October 13, 2025, the 19th Criminal Chamber of the Istanbul Regional Court of Justice ruled to “reverse the verdict” after a review of approximately 4.5 months.

The court’s reasoning centered on a technicality: while Kınık Demir was initially punished for causing both death and injury by negligence, the appeals court determined that, given the withdrawal of complaints from some injured parties, she should only be punished for the death of Batın barlasçeki. This shift in focus reduced the potential sentence from up to 15 years to a maximum of 6 years.

Financial Offers and Family Outrage

According to a statement given to BirGün, Doğan vehemently rejected these offers, stating, “They wanted to give me money many times, but even though I did not accept it, they forced me to deposit money as they wished, under the name of non-pecuniary compensation. I do not accept this money they sent to escape the punishment. My fight for justice will continue until the end. I want the society to support this case.” The lawyers allegedly deposited 500,000 TL into Doğan’s account via PTT on September 3, under the guise of “moral compensation,” a move Doğan denounced as an attempt to circumvent justice.

Withdrawn Complaints complicate Case

The case took a further unexpected turn with the withdrawal of complaints by both the victim’s father, Serdal Barlasçeki, and Yavuz Selim Öztürk, a friend of Batın Barlasçeki who was also injured in the accident. Barlasçeki submitted a petition explicitly renouncing his complaint and waiving any right to material or moral compensation. Öztürk followed suit, also withdrawing his complaint.
