Madras High Court imposes interim ban on AIADMK’s name, flag, symbol, letterhead by OPS: Details

The Madras High Court has imposed an interim ban on the use of AIADMK’s name, flag, symbol and letterhead by the OPS side. This comes after a series of legal battles surrounding the leadership and internal affairs of the party.

In the AIADMK general meeting held on July 11, 2022, resolutions were passed by removing 4 people, including O. Panneerselvam, from the party and selecting Palaniswami as the interim general secretary. In response, OPS filed a case against this, but the High Court refused to ban the resolutions passed in the General Assembly by removing 4 people, including him.

Following this, AIADMK General Secretary Palaniswami filed a petition seeking a ban on the use of AIADMK’s name, flag, symbol and letterhead by the OPS party. The case came up for hearing before Justice N. Satish Kumar, with arguments from both sides.

Palaniswami’s Senior Advocate Vijay Narayan pointed out the confusion caused by OPS identifying himself as a coordinator and announcing the expulsion of those in the AIADMK from the party. He argued that the case was pursued to put an end to this confusion.

In response, Counsel for OPS P. Rajalakshmi cited the appeal filed in the Supreme Court and requested time to file a reply. However, the judge expressed frustration with the repeated adjournments and changes in the case.

Ultimately, the judge stated, “The Supreme Court has not imposed any interim stay on the order issued by the High Court dismissing the petitions filed against the General Assembly Resolutions and General Secretary Election. Therefore, AIADMK name, flag, symbol, letterpad etc. should not be used by OPS who has been removed from the party and his party.” An interim injunction was imposed, and the case was adjourned to November 30.
