It is a dispute between two pioneers who developed differently. In court, Curevac is now demanding comprehensive information from Biontech about the use of the pioneering mRNA technology.

It’s stuffy in the large courtroom E.122 of the district court in Düsseldorf. Sabine Klepsch, presiding judge of the civil chamber 4c, charged five patent disputes in the dispute between the two pharmaceutical companies Curevac and Biontech on Tuesday. Large teams of trial and patent attorneys – the latter recognizable by the contrasting blue of their robes – as well as the numerous legal counsel of the companies have found space on the long wooden benches for both the plaintiff and the defendant. Numerous files, laptops and trolley cases have to be moved as Klepsch closes the hearing on one case and then moves on to the next point of contention.

A courtroom full of people without any evidence of infection: that would hardly have been possible at the beginning of 2022. Only one Biontech lawyer put on a protective mask on Tuesday. You sit tight together again – and share the air you breathe in the room. Because the Covid-19 pandemic has meanwhile developed into an endemic. The fear of a life-threatening illness has gone. Probably also because many citizens have been vaccinated with the vaccines from Biontech, Moderna and Astra-Zeneca. Curevac, once a pioneer of messenger RNA technology (mRNA), which is important for vaccines, failed in a clinical trial with the approval of its own vaccine in 2021.
