Bolsonaro’s Coup Attempt Appeals Rejected, Arrest Looms This Month

A unanimous decision by Brazil’s Supreme Federal Court (STF) has cleared the path for the potential arrest of former President Jair Bolsonaro and six other defendants linked to a failed attempt to undermine the country’s democratic institutions. The court’s rejection of initial appeals marks a significant escalation in the legal proceedings, with authorities already preparing for Bolsonaro’s possible detention.

The four ministers of the First Panel of the STF agreed to dismiss all appeals presented by the defense, according to reporting from CNN Brazil. The full trial ruling, which details the ministers’ votes and formalizes the outcome, is expected to be published by Tuesday, May 21st.

Last Chance for Legal Challenge

Following the publication of the ruling, the defense teams will have a five-day window to file a second appeal, known as a motion for clarification. However, this represents a final opportunity to contest the court’s decision. Only after this second appeal is rejected will a “final judgment” be declared, triggering the enforcement of any resulting sentence.

These subsequent appeals will be subject to another virtual trial by the First Panel. However, Minister Alexandre de Moraes, the reporting minister in the case, has the authority to deny these resources immediately and unilaterally.

Risk of Immediate Detention

Moraes could deem any further appeals as purely dilatory – intended only to delay the proceedings without presenting viable legal arguments. In such a scenario, an arrest order could be issued without a further trial. “If that is the case, Bolsonaro and other defendants could be arrested this month,” sources indicate.

The possibility of imminent arrest is already being taken seriously by authorities. CNN Brazil reports that the Federal District Penitentiary Administration Secretariat is actively discussing preparations for Bolsonaro’s potential detention.

Health Evaluation and Potential Prison Locations

Earlier this month, the agency requested that Moraes authorize a medical evaluation of the former president to determine if his health condition is compatible with the facilities available in Brasília’s prison system. Moraes, however, determined that it was premature to address this request.

Currently, no definitive decision has been made regarding Bolsonaro’s potential detention location. The Papuda Penitentiary Complex is among the possibilities, as is a specialized cell within the Federal Police (PF) headquarters. The defense is expected to petition for house arrest, citing Bolsonaro’s age and existing clinical conditions.
