The new housing law is sold as a panacea that will completely solve the lack of living place in Spain. Well, nothing is further from reality. Surely you are unaware of the slow process that an owner must carry out when the tenant does not pay, or in the event that a family member in the first degree of consanguinity needs to recover his home: he can spend two years or more trying to recover his living place. Adding the cost of a lawyer and solicitor to file a civil lawsuit for a verbal trial, an average of 1,500 euros.

I also suggest that you imagine the conditions of the house when it finally passes on to its owner. We have found cases where the damage exceeds 20,000 euros; Most insurances do not cover this damage, at most 1,500 euros, and only if vandalism is included in the particular specifications of the contract. Public opinion says that it is increasingly difficult to rent, but the number of cheeky ones has been increasing, leading the owner to have to ask for more and more demanding requirements. And almost always the delinquent tenant (you are restless) is insolvent, so we will not see a single euro.

Well, gentlemen, the new housing law extends the suspension of eviction for individuals from 1 month to 2 months. The conclusion we can draw from this is that the small owner is not going to rent under any circumstances; that is, fewer homes on the market for rent.

And now we move on to the second part of our beloved housing law: and to you, can it harm you? Imagine that your neighbor has had his property repossessed by the bank, or that you are unlucky enough to live in a building with busy. The large holders are obliged to an arbitration or conciliation act before the lawsuit. Surely they should do a social rent. You will think that it is unfair, the process of waiting for social housing is skipped, while the one who usurps a home (criminal offense) is rewarded by signing a rental contract.

And what about the one you know? condemn to live with antisocial people? Because that small owner must pay his mortgage every month, and even if he wants to, he can’t go to another place, so the mortgage and rent is too much. And sell? Who is going to want to buy his home in a totally degraded environment and with people with whom coexistence is impossible?

This law should be called the “law of fraud and deception.” It sells smoke, no owner can’t or wants to rent to keep the tenant in his house for a couple of years and go through a Way of the Cross until he recovers it, adding damage as well as the theft of furniture and belongings, which also occurs. You don’t have to be very intelligent to consider that it will produce the opposite effect, no matter how much IBI tax increases (up to 150%).

The person who wants to rent will not find housing to live in, and the poor who live with squatters will do so forever and ever. There are many small owners who need that rent to contribute to their small retirement, to pay for a residence, or those who move to another city due to a job change…

It is a law leaning to one side, where one party only has rights and the other party only obligations, but there can be no rights without obligations or obligations without rights, and this law is about that. Time will put everything in its place.
