Barcelona FIFA did not wait for the Extraordinary Assembly that will be held tomorrow by the Spanish Football Federation (RFEF) to open a disciplinary file against Luis Rubiales for his kiss without consent to Jennifer Hermoso and his attitude during the celebration of the World title on Saturday in Sydney (Australia). The Disciplinary Commission of the highest body of world football has already informed Rubiales of this step, which could lead to the violation of articles 13.1 and 13.2 of the FIFA Disciplinary Code, as reported in a statement by the highest body of world football.

The first paragraph of this article states the following: “Associations and clubs, as well as their players, officials and any other member and/or person performing a function on their behalf, must respect the rules of the game , as well as the FIFA Statutes and FIFA regulations, directives, guidelines, circulars and decisions, and comply with the principles of fair play, loyalty and integrity.”

And, in the second paragraph, it adds that a person may be subject to disciplinary measures when he “violates the basic norms of decent conduct; insults in any way a natural or legal person, especially by using offensive gestures, signs or language , and behaves in a way that brings football and/or FIFA into disrepute”, among others. FIFA could consider both the non-consensual kiss on Jennifer Hermoso and her crotch-grabbing gesture in the box office at the final stadium to be in breach of the code.

FIFA’s Code of Ethics provides for suspensions for “inappropriate conduct” of up to two years. In the event of a sanction on Rubiales by the highest body in world football, this would go ahead of the one that could be imposed on its president by the RFEF itself, as long as the period of ineligibility was greater. With the opening of this file, FIFA has carried forward the request of FIFPRO, the world union of footballers, which asked it last night to investigate the facts related to the behavior of Rubiales in the final of the World Cup that to win Spain and to act through its Code of Ethics.

Real Sociedad and Osasuna are also asking for Rubiales’ resignation

Aside from this move by FIFA, during this Thursday morning Osasuna and Real Sociedad, as Getafe had previously done, have asked for the resignation of Luis Rubiales as president of the RFEF. “The facts are very serious,” said the president of the Real Sociedad, Jokin Aperribay, on Radio Euskadi. “This should have ended days ago,” he added. The Basque club, moreover, will not go to the Extraordinary Assembly of the RFEF that will be held tomorrow.

Neither will the Basque Football Federation, which has issued the following statement: “Given the seriousness of the events that occurred during the World Championship final trophy presentation, and the subsequent management of the events, the Basque Football Federation will not will go to the RFEF Assembly, convened for tomorrow, Friday, August 25. In addition, depending on what happens during the next few days, a decision will be made about the continuity of our president on the RFEF board of directors.”
