In a speech on the occasion of the work of the 111th session of the Committee for the Elimination of Racial Discrimination, the director of monitoring and protection of human rights at the CNDH, Abderrafie Hamdi, recommended the establishment of a global and comprehensive legal framework to combat all forms of racial discrimination and to accelerate the adoption of the bill amending and supplementing the Penal Code, in accordance with the recommendations of the CNDH contained in its 2019 memorandum, aimed at making the draft penal code consistent with the Constitution and international human rights standards.

During this session, devoted to the examination of the 19th, 20th and 21st periodic reports on the implementation of the International Convention on the Elimination of All Forms of Racial Discrimination, the CNDH also recommended modifying the code of nationality to allow foreign men married to Moroccan women to have Moroccan nationality.

Concerning the Amazigh language and culture, Mr. Hamdi welcomed the various government initiatives to establish the official status of Amazigh, emphasizing the importance of taking all necessary legal, political and financial measures to accelerate the implementation of provisions of Organic Law 26.16 establishing the process of implementing the official character of Amazigh, as well as the modalities of its integration in education and in priority areas of public life.

Furthermore, Mr. Hamdi praised the efforts made by Morocco to protect and promote the rights of foreigners as well as to prevent any form of discrimination, inviting the government to continue to guarantee respect for the principle of non-refoulement of asylum seekers. asylum.

Between 2019 and 2022, the CNDH processed nearly 12,000 complaints and requests, of which less than 15 cases were linked to allegations of racial discrimination, Mr. Hamdi said.

Typically these were cases in the medical field, stigmatizing comments by online media that may incite hatred or racial discrimination, complaints of gender-based violence against a foreign detainee , as well as allegations of discrimination in access to justice for unregularized foreigners, he detailed.

The CNDH and its commissions have taken the necessary measures to process complaints, in particular through field visits, mediation procedures and interactions with the competent authorities, while guiding complainants in the steps to follow, continued the official. .

A Moroccan delegation, led by the Minister of Justice, Abdellatif Ouahbi, and composed in particular of the ambassador permanent representative of Morocco in Geneva, Omar Zniber, and the secretary general of the Interministerial Delegation for Human Rights, Abdelkarim Boujradi, is participating in this session, in order to highlight the multi-sectoral efforts and policies that the Kingdom is undertaking in its fight against all forms of racial discrimination.
