German Bundestag Climate Protection Legislation Vote Update: CDU Member’s Urgent Application Rejected by Constitutional Court as Inadmissible

Climate protection legislation could be passed by the Bundestag on Friday as planned. The Constitutional Court rejected the urgent application of CDU Bundestag member Heilmann, who wanted to block the vote.

With an urgent motion, CDU member of the Bundestag Thomas Heilmann wanted to prevent the Bundestag from voting on the new climate protection law on Friday and passing it with the votes of the traffic light coalition. But the Federal Constitutional Court rejected his application. This means that the vote in the Bundestag can go as planned.

Heilmann justified his application by saying that the federal government planned far-reaching changes with the new climate protection law. However, the members of the Bundestag did not have enough time to carefully deal with the changes. This violates the rights of MPs protected by the Basic Law.

“Unacceptable from the start”

The Federal Constitutional Court immediately rejected the application, justifying it by saying that “the application in the main case is inadmissible from the outset”. In other words: the entire lawsuit, as filed with the court with the urgent application, is currently inadmissible. The court’s second panel did not give any further reasons or details in its summary judgment.

“Currently inadmissible in the main case” means that the court will not be concerned with the content of the CDU MP’s arguments at present. Due to the very close decision, one can only guess why. In principle, there are high hurdles to the admissibility of cases before the Federal Constitutional Court.

Heilmann’s second trial

Last year, CDU MP Heilmann made an urgent request for more consultation time in the Bundestag on heating legislation. However, the Federal Constitutional Court stressed at the time that it would intervene in Bundestag proceedings only in exceptional cases.
