Naples Prosecutor Launches Investigation After Damaged Heart Transplant Leaves Toddler in Critical Condition
A tragic medical case in Naples has sparked a criminal investigation after a two-year-old child received a heart transplant with an organ already rendered unusable due to improper preservation. The Naples Prosecutor’s Office, under the coordination of prosecutor Nicola Gratteri, is examining potential negligence and procedural failures surrounding the December 23rd operation.
A Heart Damaged Before Surgery
The ordeal began when a heart became available for transplant following the death of a child in Bolzano. However, preliminary assessments suggest the donated organ was critically compromised. According to reports, the heart was likely damaged by the “clumsy use of ice” during transport, effectively burning the tissue and rendering it unsuitable for transplant. Despite this, a surgical team proceeded with the operation on the young recipient, identified as Tommaso, from the Nolano area.
The decision to proceed with the transplant, despite knowing the organ was damaged, is at the center of the investigation. A criminal lawyer assisting the family questioned, “But if that heart was compromised, why was this decision taken?”
Investigation Focuses on Potential Negligence
The investigation, led by prosecutor Giuseppe Tittaferrante and deputy prosecutor Antonio Ricci, is being conducted by the Carabinieri of the provincial command of Naples. Investigators are currently exploring two primary hypotheses. The first centers on potential omissions or falsifications in official documentation, suggesting medical personnel may have disregarded established protocols. The second focuses on the possibility of negligent injury to Tommaso, who underwent anesthesia and a major surgical procedure despite the known condition of the donor heart.
Family’s Plea for Answers
Tommaso’s mother, understandably distraught, expressed her desperation for her son’s recovery and a full accounting of the events. “I can’t talk, understand me. Right now I only want two things: for my son to be well and for the truth to emerge about what happened,” she stated, as reported by Il Mattino.
The family’s lawyer, Francesco Petruzzi, has already appointed a forensic medical consultant, Dr. Luca Scognamiglio, and plans to supplement a previous complaint filed with the Nola Carabinieri company with new evidence.
Critical Condition and Ongoing Search for a New Heart
Currently, Tommaso remains in critical condition in the intensive care unit of a pediatric surgery ward, kept alive by ECMO – a life-support system that temporarily replaces the function of the heart and lungs. He has also recently experienced the onset of a hemorrhage, further complicating his condition. The child is now at the top of the European list for heart donation, and a frantic search for a compatible organ is underway.
Hospital Account Under Scrutiny
According to the lawyer representing the family, the hospital initially described a “problem” with the transplanted heart, stating it wasn’t pumping effectively. However, the family was initially told the transplant had been carried out successfully. This discrepancy has fueled further questions and concerns.
