Israel Establishes Special Religious Court for War Widows

In a groundbreaking move, Israel has formed a special religious court, or rabbinical court, for the divorce process of wives who have lost their husbands in clashes with Hamas. The announcement was made by Israel’s Chief Rabbi David Law on Monday, as reported by the ‘Jerusalem Post’.

The move comes in response to the strict conditions for women to obtain a divorce under Jewish religious law, or Halacha, where the husband is required to produce a document known as ‘Get’ before the religious court. Without this document, women are unable to remarry, and any children born during this period may face complications in terms of paternity. However, these restrictions do not apply to men in the same way.

To address this issue, a special rabbinical court has been established to remove this religious barrier for war widows, particularly in the event of the Israel-Hamas conflict. This court will grant the divorce if the husband is confirmed to be deceased and there is no proof of his being alive.

The special court will consist of three judges, including Rabbi Law, Rabbi Eliezer Igra, and Rabbi Zvi Ben-Yaakov. Rabbi Eli Ben-Dahan, the Director of the Rabbinical Court, has announced that all war-related divorce cases will be referred directly to this special court.

This new initiative aims to streamline the divorce process for women who have lost their husbands in the Gaza war, providing them with the opportunity to move on and remarry without the religious barriers that have previously complicated the process. In doing so, Israel is taking a progressive step towards addressing the needs of war widows within the framework of religious law.
