The former head of the Superintendence of Tax Administration (SAT) and lawyer is linked to the Blackmail, Impunity and Money Laundering case.

On April 20, the Special Prosecutor’s Office against Impunity (Feci) of the Public Ministry (MP), in coordination with the National Civil Police (PNC), coordinated the capture of Solórzano Foppa and Justino Brito Torrez, for the possible commission of the crime of hindering criminal action. Both are also accused of unfaithful sponsorship, according to authorities.

Solórzano Foppa published a video on his social networks in which he mentions that he renounced the challenge he had filed against Sergio Mena, Seventh Penal Judge, since he decided to submit to the figure of acceptance of charges because he considers that he will not have a fair trial .

“I believe that many of my constitutional and procedural rights are being systematically violated and I am not having a fair trial, I am not going to have a fair trial and that is why I also want to tell you that today I am going to accept charges, I am going to present a memorial of acceptance of charges in the Seventh Court, we are also going to present another memorial in another court in another process in which I am submitting, because honestly it is not worth it in this justice system”, said Solórzano Foppa.

He commented that he has been in court for five years and that he has proudly worn his handcuffs.

“I am not ashamed to say it, if I am going to accept charges, I want all of you to know, it is not because I have done something wrong, it is not that I have committed any crime, it is simply because I am going out to continue fighting, I’m going to get out of jail fighting, I’m going to get out of jail to keep fighting, I’m going to get out of jail to keep litigating the cases I’ve brought against the Foundation against Terrorism, against this system,” he said. Solórzano.

“Don’t see I’m going to give up”

He added: “I am not going to surrender, I am not going to leave Guatemala, I am going to go free, I am going to go free accepting charges, yes, but I will proudly carry that sentence just as I have proudly carried these handcuffs, because this The justice system is honestly rotten, from the Public Ministry, some judges from the Judicial Branch, the same Police that are now using crimes against life, anti-kidnapping, to come and arrest us or former officials,” Solórzano said in his video.

At the hearing on June 2, Solórzano renounced the challenge of the judge and said that he was within his right to do so, based on article 19 of the Law on the Judiciary. He added that he had presented, before the Seventh Court, a memorial to submit to a process of acceptance of charges and asked the magistrates to learn more about this action, to expedite the process.

Solórzano Foppa pointed out that he has not been allowed to use computers to defend himself, even though the same judge accepted him as a lawyer, but has not given him the opportunity to defend himself.

“One of the pieces of evidence, according to them the main piece of evidence, presented by the Public Ministry is a video, so how can I see the video if it is not in an electronic medium?”

“I want the judge to sentence me, because when he sentences me he will sentence himself, because he himself authorized me in court, within this same case, to act as such then it seems unheard of to me that a judge first in a hearing says one day that this is legal and the next day says that the same thing that he authorized is illegal.

He recalled the case of Jose Rubén Zamora, for which he was a lawyer, and pointed out that they were never allowed to present evidence.

He affirmed that he does not care that his criminal record is stained, because the sentence that they are going to do will not be because he has committed a crime.

Solórzano Foppa also said that they cannot be disqualified from his role as a lawyer and that he will continue to litigate.

He made a comparison of other cases where people accused of stealing millions of quetzales are free, while he is sentenced.
