Judge Recuses Himself from Ilayaraja Song Ban Case

Chennai: Judge R. Subramanian has recused himself from the hearing of the case filed by Echo Recording Company seeking to remove the ban imposed on the use of songs composed by Ilayaraja.

Echo Recording and Aki companies had signed a contract with Ilayaraja to use more than 4,500 songs of Ilayaraja’s music on behalf of their companies. But after the termination of this contract, Ilayaraja filed a case against Ekko and Aki companies in the Madras High Court, claiming that the companies continued to use the songs composed by him without obtaining copyright.

The single judge who heard the case ruled that the music companies have the right to use Ilayaraja’s songs. The judges who heard Ilayaraja’s appeal filed an interim stay on the order of the single judge.

In this case, since the copyright of those films is with the producers, as they have the right to use the songs of those films based on the agreement made with the producers, the ban imposed on the use of Ilayaraja’s songs should be removed, a case was filed in the High Court on behalf of Echo Recording Company.

Judges R. Subramanian, R. Sakthivel was heard yesterday in the session. At that time, Judge R. Subramanian said that he would recuse himself from the trial of this case. It is then recommended to the Chief Justice to transfer the case to another Bench.
