He Internal Revenue Service (SRI) announced this March 8, 2023 that, “as a result of its permanent control actions,” it has detected fraudulent behavior in the taxpayers who work under the modality of dependency relationship.

These behaviors, according to the tax administration, seek to pay less taxes and even receive tax refunds.

One of the most common fraudulent practices of these taxpayers is hand over your keys and allow third parties to modify the values ​​of your income tax returnto generate balances in favor that are not real and thus benefit from an improper return.

Another of the practices detected, according to the SRI, is to present their income tax returns, altering the value of your taxed income in order to generate a favorable balance and request a refundwhich constitutes a crime of tax fraud.

«The SRI reminds citizens that if there is an act of simulation, concealment, omission, falsehood or deception that leads to error in improperly obtaining a refund of taxes, it will be considered a crime of tax fraud with a custodial sentence of 5 to 7 years (Art. 298 COIP)”, assured the tax administration through a statement.

More controls on natural persons

The SRI is implementing greater controls to reduce income tax evasion. This includes monitoring before individuals begin to declare and pay income tax from March 2024.

Based on data analysis and taxpayer behavior, the SRI assures that it has identified the average income tax that natural persons should declare according to their economic activity.

Thus, prior warnings will be sent about the value, according to the tax authority, that taxpayers must pay, If they declare less than the average of their activity, the SRI will undertake an audit of the taxpayer. There is talk of an express audit lasting a maximum of one month.

Another measure that has already been taken is to increase the percentages of Income Tax withholding made to natural persons.
