The conservative majority of the acting General Council of the Judiciary (CGPJ) has asked the president of the institution to convene an extraordinary plenary session to rule on the criticism of the judges expressed this Tuesday in the Congress of Deputies by spokespersons for various parliamentary groups during the debate on amnesty. The petition letter, to which elDiario.es has had access, states that these demonstrations were carried out with the “acquiescence” and “mutism” of the president of the Chamber, the socialist Francina Armengol.

The expired Judiciary comes to the defense of García Castellón in the face of criticism from Vice President Ribera

The members who subscribe to this petition are Gerardo Martínez Tristán, José María Macías, José Antonio Ballestero, Nuria Díaz Abad, Juan Manuel Fernández, Juan Martínez Moya, Carmen Llombart, María Ángeles Carmona and Wenceslao Olea. They were all elected at the time at the proposal of the PP. The CGPJ regulations establish that it is enough for the president to decide or five members to request it so that a plenary session must be convened within three days following the request.

The governing body of the judges has had its mandate expired since December 2018 due to the blockade of the formation now led by Alberto Núñez Feijóo and has operated since then with a correlation of forces of a conservative majority that has nothing to do with the current parliamentary majority.

In different terms and with different intensities, spokespersons for Sumar, Junts, Esquerra Republicana and Podemos assured this Tuesday from the podium that there are judges who are committing “prevarication” to prevent the future amnesty law from being valid. Most of the criticism was directed against the judge of the National Court Manuel García Castellón, who attributed a possible crime of terrorism to the former president of the Generalitat Carles Puigdemont last November, in the midst of negotiation for the law of criminal forgetfulness of the process, despite because the case was opened four years earlier and the events to which it refers date back to 2019, after the publication of the procés ruling.

On January 19, the Permanent Commission of the body unanimously issued a statement in which it came out in defense of Judge García Castellón in the face of criticism from Minister Teresa Ribera. In statements to TVE, the head of the Ecological Transition portfolio and third vice president had assured that the judge of the National Court has a “certain desire” to speak out in “sensitive political moments” on matters of public relevance.

The governing body of the judges then issued a statement in which it stated that it had the “most absolute respect” for the freedom of expression of the third vice president of the Government, but added that these statements “are contrary to the principle of institutional loyalty” and “ to the general duty to respect judicial independence.”
