The epilogue is near… This Thursday, the social chamber of the Court of Cassation is looking into a subject that has caused a lot of ink to flow for seven years: the industrial tribunal compensation scale in the event of unfair dismissal, says “ Macron scale”, which the president ended up imposing at the end of 2017 in the labor code. And this, after having tried twice to do so, in 2015 in its growth law and in 2016 in the labor law carried out by Myriam El Khomri.
The highest court in the judiciary will thus examine on the merits four cases, which have been submitted to it by courts of appeal, in which the scale put in place in 2018 was not retained although it was supposed to apply. An important audience for all the bosses, because the very future of the scale is at stake if the decision goes in the direction of the employees… “This system has brought greater legal certainty for employers and has made it possible to reduce industrial tribunal disputes which were completely congested.»…
