The elections for the presidency of the Royal Spanish Football Federation (RFEF) are in the hands of the State Attorney’s Office. The Government is waiting for a report from this organization to be able to launch the Ministerial order that must regulate the way in which the Federation will appoint the replacement for Luis Rubiales, who resigned as president of the organization on September 10, cornered by his non-consensual kiss with Jenni Hermoso.

Sources of Higher Sports Council (CSD) explain that this is the last procedure that remains to be able to activate the electoral machinery, which will also affect the rest of the national Olympic sports federations, although all except football will in principle hold their elections when appropriate by default, in the second semester of this year, once the Paris 2024 Olympic Games have been held.

The State Attorney must issue a report on the draft prepared by the CSD. Once the Government receives it, the general technical secretariat of the body that governs Spanish sport will review it to prepare the text, which will be final once it is published in the Official State Gazette.

A process that is lengthening

The process for the final publication of this Ministerial Order is taking much longer than the CSD had anticipated. Even with Víctor Francos as president of the organization, the Government published the draft of the text on October 11, to be submitted to public information, so that all interested parties could send their contributions to the text.

Francos then counted on being able to complete all the bureaucratic procedures towards end of November or beginning of December. However, as explained by the CSD, the volume of contributions received, more than 1,400 pages has slowed down the process.

“Both what is accepted and what is rejected has to be justified and included in a report. This is what explains the time of analysis that is being needed, due to the large volume of contributions,” the Government argued during those weeks. .

Once that process was completed, the CSD elevated the Sports Administrative Court (it is the body responsible for electoral matters) that text, in accordance with the procedures established by current legislation, to prepare a mandatory report on the matter. This report is already in the hands of the Government, which is now waiting for it to be issued by the State Attorney’s Office.

Change of power in the CSD

The CSD refuses to set deadlines, but it is expected that all these procedures can be completed shortly. We will then have to see how many variations have occurred with respect to the original text. It is worth remembering that at the beginning of the process the minister (acting) was Miquel Iceta and the president of the CSD was Victor Francoswhile now they are Pilar Alegría and José Manuel Rodríguez Uribes, respectively, so there may also be changes of a political nature, as those responsible for Sports in the Government have changed.

When the Ministerial Order is definitively approved, the RFEF must prepare own electoral regulations that conforms to the requirements of the government text. The CSD forecast at the time was that there could be a new president of the Federation around the month of April, but this delay will also affect those deadlines. In fact, It is not at all ruled out that the elections will not be held until after the Olympic Games and that, therefore, Rocha accelerates Rubiales’ mandate as interim.

And all this occurs while awaiting a future ruling from the TAD regarding the decision of the president of the RFEF managing commission, Pedro Rocha, not to call elections imminent after the resignation of Rubiales. This Wednesday, the CSD submitted a complaint to the TAD regarding Miguel Ángel Galán. A procedure by the Government that “responds to the correction requested by the TAD and that continues the process started a few months ago”, given that Francos had already filed that complaint.
