The SME Confederation launches a petition against the acquisition of paid leave during sick leave

The confederation of SMEs (CPME), strongly opposed to the acquisition of paid leave by employees on sick leave decided in September by the Court of Cassation, launched a petition on Monday in which it asks the government to “act” against this measure.

On September 13, the social chamber of the Court of Cassation rendered several decisions granting sick or injured employees paid leave during their period of absence, even if the latter was not linked to a work accident or a occupational disease. This decision, explained the Court, “brings French law into conformity with European law regarding paid leave”.

Work value “under attack”

Employers fear this measure, the cost of which they estimate at around two billion euros per year, with the fear of also being imposed retroactivity of three years. The CPME in particular said on Monday that it was “resolutely opposed to the acquisition of paid leave during sick leave”. “Basically,” she explains in her press release, “decoupling actual work and paid leave is deeply shocking. It is the value of work which is thus attacked. »

Furthermore, according to her, “it is completely unfair that an employee absent for a long period benefits from as much leave as an employee present at his post”. Finally, she considers “inadmissible” the retroactivity “which will allow employees to (…) claim paid leave for their sick leave over the last three years”.

The SME Confederation believes that this decision risks “condemning certain SMEs” and invites the government “to understand the indignation of business leaders and (to) act”. The petition is available on the CPME websitethe leading French employers’ organization in terms of number of members, with 243,000 companies employing four million employees.
